| Descripción : | En el moderno Estado de Derecho el Derecho penal se justifica como garantía de lalibertad, por lo que no cabe usarlo para suprimir la libertad individual en nombre de la seguridadcolectiva. Es ese presupuesto de la libertad y el supremo valor del individuo el que da sentido a losprincipios penales de culpabilidad y proporcionalidad. El Derecho Penal del Estado de Derecho estambién un Derecho penal de asunción de riesgos, pues arriesgado es castigar al delincuente sineliminar de raíz so humanidad y su libertad. In the modern rule of law, criminal law is justified as a guarantee of freedom, so it cannot be used to suppress individual freedom in the name of collective security. It is this presupposition of freedom and the supreme value of the individual that gives meaning to the criminal principles of guilt and proportionality. The Criminal Law of the Rule of Law is also a criminal law of risk-taking, since it is risky to punish the offender without eliminating his humanity and freedom from the roots. |
