| Descripción : | The present work has as aim analyze the space of the justice in the minors' jurisdiction in Argentina, more precisely, the case of the province of Santa Fe. First there will fulfill a brief historización of the passage of the law of Minors’ Patronage 10.903 to the National law of Integral Protection of the Laws of the Girls, Children and Teenagers 26.061. Here we will center on the tension that persists between the care and the penalty of the teenager, this joined the debate brings over of the growth of the civil insecurity and as this one it turns into the frame for the “order” of the increase of the severity of the legal punishment. Also we will approach the intervention of the Direction of Penal Juvenile Justice of the province of Santa Fe and will do area in one of his measures: Freedom’s Privation in Closed Institutes. A theoretical analysis will be realized on the same ones, this one will be in the context of the capitalism and of the great development of the culture of the consumption. El presente trabajo tiene como objetivo analizar el espacio de la justicia en el fuero de menores en Argentina, más precisamente, el caso de la provincia de Santa Fe. En primer lugar, se realizará una breve historización del pasaje de la ley de Patronato de Menores 10.903 a la ley Nacional de Protección Integral de los Derechos de las Niñas, Niños y Adolescentes 26.061. Aquí nos centraremos en la tensión que persiste entre el cuidado y la penalización del adolescente, esto unido al debate acerca del crecimiento de la inseguridad ciudadana y cómo éste se convierte en el marco para el “pedido” del incremento de la severidad del castigo legal. También abordaremos la intervención de la Dirección de Justicia Penal Juvenil de la Provincia de Santa Fe y haremos foco en una de sus medidas: Privación de Libertad en Institutos Cerrados. Se realizará un análisis teórico sobre los mismos, este será en el contexto del capitalismo y del el gran desarrollo de la cultura del consumo. |
